R.P. Nagrath, J. (Oral) Prayer in the instant petition is made under Section 439 Cr.P.C. for grant of regular bail in FIR No. 49 dated 02.06.2012 for offence under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, registered at Police Station Garh Shankar, District Hoshiarpur.

Learned State counsel on instructions from ASI Om Parkash submits that the case is at the final stage as the evidence has since been closed.

Learned counsel for the petitioner, however, submits that against the order passed by learned trial Court on the application filed by the defence under Section 294 Cr.P.C., CRMM-4888 of 2015 is pending before this Court. However, no stay has been granted by this Court in that petition. Learned State counsel does not dispute the fact that out of 10 accused persons 7 have been granted regular bail by this Court and from rest of the persons there was also recovery in this FIR, though no such recovery was made form the JITENDER KUMAR 2015.08.25 10:14 I attest to the accuracy and integrity of this document

The petitioner is in custody since 10.09.2012 and it will take time in conclusion of the trial.

In view of the above and without commenting on merits of the case, the instant petition is allowed and petitioner be admitted to bail on furnishing bail bonds to the satisfaction of the trial Court.
