By way of filing the present application under Section 24 of C.P..C, petitioner Sarita, who is respondent in the divorce petition filed by her husband Pardeep pending before Principal District Judge, Family Court, Panipat seeks transfer of that petition to the Court of competent jurisdiction at Rohtak for the following reasons :- 2.

1.

that she is residing along with her widowed mother at Rohtak.

2.

that there is distance of 77 kms between Rohtak and Panipat and it is difficult for her to travel alone. 3.

that there is threat to the petitioner from the side of respondent and his family members.

4.

that three more cases are pending in the Court at Rohtak. 3.

Notice of this petition was given to respondent who was duly served but did not put in appearance, as such has been proceeded against exparte. 4.

I have heard learned counsel for the applicant besides going through the record.

I find sufficient reasons to accept the application. Therefore, the application is allowed. The divorce petition titled 'Pardeep versus Sarita' bearing No. DMC/22/2022 pending in the Court of Principal District Judge, Family Court, Panipat is ordered to be withdrawn from that Court and transferred to the Family Court at Rohtak. The Court of Principal District Judge, Family Court, Panipat is directed to send the record of the case to the transfree Court at the earliest where the parties would appear on 3.8.2023. (H.S.
