Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No.67 dated 05.04.2015 under Sections 420, 406 and 120-B IPC, registered at Police Station Division No.7, Ludhiana City, District Ludhiana. Notice of motion was issued and learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. At the time of arguments, learned counsel for the petitioner argued that complainant Satnam Singh has given an affidavit copy of which is Annexure P-4 on the file. CRM No.M-18849 of 2015 -2executed and the parties have settled their matter. Otherwise also, the petitioner has joined the investigation and she is not required for custodial interrogation. Nothing is to be recovered from her. Moreover, the dispute between the parties looks like civil matter. No useful purpose will be served by sending the petitioner to custody. Keeping in view the facts and circumstances of the case and without discussing the merits of the case in minute details and without expressing any opinion on the merits of the case, I find merit in the present petition and the same is allowed.
