The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.220 dated 28.10.2016 (AnnexureP.1) registered for the offences under Sections 306 and 506 IPC at Police Station Civil Lines, Batala, Police District Batala, District Gurdaspur. Notice of motion has been issued in this case. Mr. Gaurav Garg Dhuriwala, learned Senior Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and Mr. G.S. Simble, learned Advocate has appeared for the complainant and contested this petition.
Cr. Misc. No.M-18903 of 2017 [2] I have heard learned counsel for the parties as well as learned State counsel appearing for the respondent-State and have gone through the record.
From the record, I find that the FIR has been registered on the statement of one Lakhwinder Singh. His son Jasbir Singh have good relations with Jaswinder Singh, Satbir Singh Ghuman and Daswinder Singh. They told to his son that they want to go to Canada and some agents are known to them and they had already sent so many persons to Canada. These three persons told the name of agent Amrit Pal Singh Goraya. As per the FIR the money was paid to another co-accused Abhijeet Arora. A civil suit was also filed by Jasbir Singh (since deceased) against Jaswinder Singh, Satbir Singh Ghuman, Daswinder Singh, Pardeep Singh and Gurpreet Singh, copy of which has been placed on record as Annexure-P.3, but this suit is stated to have been filed just some days before the occurrence and no where anything has been attributed to the present petitioner.
The present petitioner has been in custody since 22.2.2017. The trial of the case will take long time. The investigation is already complete and the challan has been presented. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.
Cr. Misc. No.M-18903 of 2017 [3] one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
