Limited prayer made in the revision petition is for expunging findings recorded by the Trial Court while deciding an application filed by the petitioners/plaintiffs under Section 10, CPC. 2.
Counsel for the petitioners submits that the Trial Court has expressed its opinion on the merits of the suit despite the fact that the parties are yet to lead evidence. He asserts that as the proceedings in the civil suit are likely to be prejudiced, the findings recorded by the Trial Court in the impugned order may be annulled.

After having heard counsel for the petitioners, this Court is of the view that no interference is called for in the order dismissing the application under Section 10, CPC. However, it is clarified that the observations made therein shall have no bearing on the decision to be taken by the Trial Court in the civil suit on merits.
