The petitioner through instant petition under Article 226 of Constitution of India is seeking setting aside of communication dated 22.02.2023 whereby test for the post of Assistant conducted by the respondents has been cancelled.

Learned counsel for the petitioner submits that the respondents invited applications for various posts on direct recruitment basis including 30 posts of Assistant. The respondents conducted exam which was online. The petitioner and other candidates participated in the exam. The respondents after conducting verification of documents declared select list, however, before issuing appointment letter, the respondents vide impugned order dated 22.02.2023 cancelled the exam without assigning any reason. 3.

CWP-5743-2023 -22023:PHHC:114729 representation to the authorities, thus, no reason for cancellation of exam has been communicated. The petitioner has no vested or fundamental right against the post. The petitioner was not issued appointment letter and few candidates were shortlisted which included the petitioner. Nevertheless, if petitioner makes any representation, the competent authority would look into the representation and communicate the reply within 08 weeks. 4.
In the wake of statements of learned counsel for the parties, the petition stands disposed of with liberty to the petitioner to make representation.
