DAILY LOK ADALAT BENCH NO.3 CWP NO.19851 OF 2002 SAHIB SINGH AND SONS V/S CHANDIGARH ADMINISTRATION AND ORS.

* * * *

Present:

Mr. Nipun Sharma, Advocate For Mr. D.C. Patwalia, Advocate For the appellant.

* * * * In response to the notice, Mr. Nipun Sharma, Advocate has put in appearance on behalf of the petitioner and states that he is no longer a counsel in the case as the petitioner has taken away the brief. Counsel for the Union Territory has also not put in appearance.

The challenge in this petition is to the orders passed by the respondent authorities relating to recovery of rent and imposition of penalty etc. Initially stay order was granted on deposit of 50% of the rent amount due, but later on vide order dated March 14, 2003, the stay order was vacated as the amount had not been deposited. In this view of the matter, we are of the opinion that the petition has become infructuous and is, accordingly, disposed of as such. File be consigned.

Liberty is, however, granted to the petitioner to get it revived by moving an appropriate application/s, if need be. (G.C. GARG) PRESIDENT (N.K. KAPOOR) MEMBER April 27, 2016 naina NAINA KATHIAT 2016.04.28 15:20 I attest to the accuracy and integrity of this document
