(ORAL) Learned counsel for the petitioner, at the very outset, submits that in view of the written statement filed on behalf of respondent No.3, cause of action does not survive any further and the writ petition may be disposed of, as having been rendered infructuous, however, with liberty to the petitioner to approach this Court again, as and when necessity arises.

Learned counsel for the petitioner relies on the contents of para 2 and 3 of the preliminary objections of the written statement, which read as under:- AMIT KUMAR 2015.02.16 13:32 I attest to the accuracy and authenticity of this document

Civil Writ Petition No. 9061 of 2000 2 "The letter dated 14.6.2000 was sent to Registrar Cooperative Societies, Haryana for rescinding of item No.5, 6, 13 and 14 as provided under Section 27 of the Haryana Cooperative Societies Act, 1984 and in the light of the instructions and norms of the Cooperative Department. No reply received as yet.

That therefore, the present writ petition is pre-mature and liable to be dismissed in limini." On the basis of the abovesaid averments taken by respondent No.3, learned counsel for the petitioner also submits that since item No.6 in resolution dated 22.12.1999 was sought to be rescinded by the respondent-Bank vide resolution dated 6.6.2000, present writ petition may be disposed of with liberty aforesaid. In view of the abovesaid statement made by learned counsel for the petitioner, instant writ petition is disposed of, as having been rendered infructuous, however, with liberty as prayed for.
