NARESH KUMAR SANGHI, J.(ORAL) CRM-23100-2015 Learned counsel for the applicant-petitioners submits that the prayer made in the present criminal miscellaneous application has already been accepted vide order dated 27.07.2015 and, as such, it has been rendered infructuous. Ordered accordingly.
-2CRM-M-19015-2015 Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioners, Harbans Singh and Piar Kaur, who have been booked for having committed the offences punishable under Sections 120-B, 354, 406, 498-A and 506, IPC, registered at Police Station, Women Cell, Ferozepur, District Ferozepur.
At the very outset learned counsel for the petitioners contends that he may be permitted to withdraw the present petition on behalf of petitioner No.1-Harbans Singh. Learned counsel for the State has no objection to the above prayer.
Dismissed as withdrawn qua petitioner No.1-Harbans Singh.
Learned counsel for the State, on instructions from ASI Ajaib Singh, Police Station, Women Cell, Ferzoepur, submits that in compliance of the order, dated 04.06.2015, petitioner No.2-Piar Kaur has joined the investigation and her custodial interrogation is not required.
In view of the above, interim directions issued vide order dated 04.06.2015 passed by this Court are made absolute
-3qua petitioner No.2-Piar Kaur. She shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2), Cr.P.C. Interim directions issued on 04.06.2015 qua petitioner No.1-Harbans Singh are hereby withdrawn.
However, in case petitioner No.1-Harbans Singh surrenders before learned Area Judicial Magistrate and moves an application for grant of regular bail, the same shall be disposed of in accordance with law as expeditiously as possible. August 20, 2015 (NARESH KUMAR SANGHI) meenu JUDGE
