***** RAJESH BHARDWAJ, J (ORAL) This petition has been filed under Section 482 Cr.P.C. for issuance of directions to respondents No.2 and 3 to protect the life and liberty of the petitioner who is being harassed at the instance of respondents No.4 and 5. Learned counsel for the petitioner submits that though there are allegations made by the petitioner that he was illegally picked up from his home, however, he restricts his prayer only for protection as he would pursue his remedy regarding his grievances of allegedly having been arrested as available under the law. He further submits that the respondents against whom he has threat, are said to have shifted to Australia and he fairly submits that thus, the threat perception as on date against the respondents does not survive. Learned State counsel submits that the allegations made against the petitioner have already been enquired into and the same were not substantiated. However, he submits that the State is duty bound to provide him protection, in case the same is required.
After hearing learned counsel for the petitioner and perusing the record, the present petition is disposed of. However, liberty is granted to the petitioner to avail his remedy as available to him under the law. (RAJESH BHARDWAJ) 25.04.2023 JUDGE D.Bansal Whether speaking/reasoned :
