The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.36 dated 1.3.2014 registered for the offences under Sections 420 and 120-B IPC at Police Station Navi Baradari, Jalandhar, District Jalandhar.

Notice of motion has been issued in this case. Ms. Monika Jalota, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Deputy Advocate General, Punjab appearing for the respondent-State and have gone through the record.

Cr. Misc. No.M-19989 of 2018 (O&M) [2] From the record, I find that the FIR in the present case is dated 1.3.2014. As per the order passed by the learned trial Court, the present petitioner was declared proclaimed offender and two PWs were recorded under Section 299 Cr.P.C. and then the file was consigned to the record room. The anticipatory bail application of the petitioner was dismissed by the learned Additional Sessions Judge, Jalandhar vide order dated 22.3.2017. After the dismissal of his anticipatory bail application by the learned Additional Sessions Judge, he kept silent for such a long period and filed the present petition on 15.1.2018 and there is no explanation as to why the anticipatory bail petition was not filed immediately. Furthermore, when the petitioner has already been declared proclaimed offender, no ground is made out to grant him the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
