The present petition has been filed under Section 482 of the Code of Criminal Procedure for quashing of FIR No.89, dated 02.02.2020, registered under Section 174-A of IPC at Police Station Suraj Kund, District Faridabad along with all consequential proceedings arising thereof. 2.

After arguing for some time, learned counsel for the petitioner prays for withdrawal of the instant petition with liberty to raise all pleas before the trial Court at the appropriate stage. He however, prays that the trial Court be directed to grant exemption to the petitioner from personal appearance as the petitioner is 85 years old lady and suffering from old-age ailments. However, she is ready to furnish an undertaking by way of affidavit to appear before the trial Court on the dates, for which her presence is absolutely necessary. 3.

Dismissed as withdrawn with liberty aforesaid. 4.

In case the petitioner files an application for grant of exemption from personal appearance, the trial Court shall sympathetically consider the same keeping in view the aforesaid facts.
