The petitioner is facing trial in case FIR No.216 dated 20.07.2012 for the offence punishable under Section 21 of Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station Tripuri, District Patiala. He absented during the trial on the date fixed i.e. 04.03.2015 and his bail bond and surety bond were cancelled. Learned counsel for the petitioner submits that petitioner was not well on that day, as such, could not appear. He moved the application for bail on 24.03.2015, which was declined. CRM-M-19036-2015 -2as per order dated 04.06.2015 Keeping in view that the petitioner has put in appearance and is facing trial, the order dated 04.06.2015 is made absolute, till the disposal of the case before the trial Court. However, the trial Court will be at liberty to proceed against the petitioner under Section 446 Cr.P.C. for his absence on 04.03.2015.
