On the instructions of ASI Janpal Singh, it has been informed that the petitioner has joined the investigation. In view of the fact that challan having been presented and in view of a bank draft of Rs. 2.00 lacs in the name of the complainant, having been handed over to the investigating officer, the petitioner can be granted the concession of pre-arrest bail.

Accordingly, the petition is allowed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that he will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. The investigating officer will be at liberty to hand over the bank draft to the complainant in case a request in that concern is made by the complainant. It is made clear that the payment of sum of Rs.2.00 lacs, pursuant to the interim order passed by this court, will not prejudice the right of the complainant or the petitioner so far as the trial or any other proceedings, are concerned.
