This is a petition filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 312, dated 25.11.2021 registered under Section 307 read with Section 34 IPC and Section 25/29-54-59 of Arms Act, at Police Station Rajound, District Kaithal.

The FIR was registered on the statement of Paramjeet Singh, who stated that on 24.11.2021 at about 8:00 P.M. he along with one Gurcharan Singh and some other persons were standing at the chowk near Gurdev Kirana store at village Mandwal. Meanwhile Lucky and Manga came there on a motorcycle. They fired at him from a country made pistol with an intention to kill him. He suffered gun shot injuries. Gurcharan also received pallet injuries. Thereafter, both the accused fled away from the spot with their respective weapons. The complainant became unconscious and was taken to Civil Hospital, Kaithal from there he was taken to Shree Shyam Multi Speciality Hospital at Assandh for treatment. The name of the petitioner has come in the disclosure statement of Mangal Singh @ Manga who stated that the country made pistol which was used in the incident had been purchased from the petitioner for a sum of Rs. 7,000/-.

CRM-M-13328-2022 (O&M) The petitioner is in custody since 21.12.2021. The investigation in the case is complete.

Ld. Counsel for the petitioner states that other than the disclosure statement there is nothing to connect the petitioner with the crime. Even as per the disclosure statement, it is not the case of the prosecution that the petitioner shared a common intention with the other accused. The only allegation being that the country made pistol used in the crime had been purchased from the petitioner for a sum of Rs. 7,000/-. Hence, petition is allowed. Petitioner Chetan @ Cheta is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Duty Magistrate concerned.
