CRR-815-2020 2023:PHHC:136663
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRR-815-2020 (O&M) Decided on: 19.10.2023 Sushil Bansal and Anr.
...Petitioners
Versus
State of Haryana
...Respondent
CORAM:
HON'BLE MR. JUSTICE ANOOP CHITKARA
Present:
None for the petitioners.
Mr. Gurmeet Singh, AAG, Haryana.
**** ANOOP CHITKARA, J.
Called twice, however, none has appeared on behalf of the petitioners. On 13.10.2023, this Court had passed the following order:- "On the last date of hearing, none appeared on behalf of the petitioners and today also, they are unrepresented. In the interest of justice, list on 19.10.2023. State to get instructions about status of the case before the trial Court. It is clarified that in case, petitioners remain absent on the next date and the trial is found to be pending, this Court shall proceed further by appointing legal aid counsel on behalf of the petitioners.
Despite being matter passed over, the petitioners are still unrepresented. State counsel submits that trial is going on and out of 73 witnesses, 29 witnesses have already been examined.
It appears that the petitioners are not interested to pursue the present revision petition and that is why none is representing them. Furthermore, since the order is against the framing of charges, the purpose would be achieved if the trial Court expedite the matter.
Given above, the present petition is dismissed for non-prosecution. The trial Court is directed to expedite the trial State counsel shall apprise the trial Court about this order. (ANOOP CHITKARA) 19.10.2023 JUDGE jyoti3 Whether speaking/reasoned:
