The petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.41 dated 10.5.2017 registered for the offences under Sections 21 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the NDPS Act') at Police Station Khalra, District Tarn Taran. Notice of motion has been issued in this case. Mr. Pawan Sharda, learned Senior Deputy Advocate General, Punjab has appeared on behalf of respondent-State and contested this petition.

As per the prosecution version in the present case about one Kg. 500 Grams Heroin had been recovered from the field, which was possessed by the present petitioner. There was also a secret information against the petitioner.

A perusal of the record shows that the recovery is commercial quantity and Section 37 of the NDPS Act bars the grant of benefit of bail to the petitioner. At this stage, there is nothing on record to show that the petitioner is not guilty or he has been falsely implicated. Therefore, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I do not find any merit in this petition and the same is dismissed.
