Mr. L.S.Mann, Advocate, for the petitioner Mr. C.S.Brar, DAG, Punjab, for the respondent Fateh Deep Singh, J. (Oral) The allegations in this regular bail application under section 439 Cr.P.C. against petitioner-Satto @ Satya Devi are that she along with her co-accused were held liable for death of Anita alias Barkha sister of Surinder Kumar alias Sammi on account of matrimonial dispute between the deceased and her husband.

The contentions of the counsel for the petitioner are that earlier the petitioner was found innocent and was placed on column no. 2 and subsequently, the petitioner was summoned under the provisions of section 319 Cr.P.C. and that she has been arrested on 8.12.2015 and since then is in custody and that the trial is not likely to be concluded in near future. This factual position has been duly conceded by the learned State counsel at the bar, on instructions from ASI Gurnam Singh, but has tried to oppose the bail.

Criminal Misc. No. M-20075 of 2016 -2Having regard to the fact that the petitioner was earlier found innocent and has been subsequently summoned with the aid of section 319 Cr.P.C. and her culpability, if any, shall be determined at the time of trial which is not likely to be concluded in near future, no purpose will be served by detaining the petitioner in jail.

In view of the aforesaid, without meaning to express any opinion on the merits, the instant bail petition is allowed. Bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Amritsar. ( Fateh Deep Singh ) July 08, 2016 Judge 'tiwana'
