NARESH KUMAR SANGHI, J.(Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Anil Panchal, who has been booked for having committed the offences punishable under Sections 120-B, 420, 467, 468 and 471, IPC, in a case arising out of FIR No.47, dated 23.01.2015, registered at Police Station, City, Jind, District Jind.

CRM-M-19144-2015 (O&M) -2that in compliance of the interim directions issued by this Court, vide order dated 02.07.2015, the petitioner did join the investigation. He further fairly concedes that on 01.10.2015, the petitioner suffered the statement before the learned Chief Judicial Magistrate, Jind, that he was ready to undergo the Polygraphic test. However, the said machine was not in order and, as such, he could not undergo the said test. He further states that if the petitioner undertakes to go through the said test after the machine becomes in order then he has no objection to grant of anticipatory bail to the petitioner.
In view of the above, interim directions, issued vide order dated 02.07.2015 are made absolute. He shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2), Cr.P.C. It is made clear that the petitioner shall undergo the lie detector test as per his statement, dated 01.10.2015, suffered before the learned Chief Judicial Magistrate, Jind, as and when the Investigating Agency issues him the notice under Section 160, Cr.P.C.
