**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, the grievance which is being raised by the petitioner is that though he retired on 31.07.2018, but the pensionary benefits for which he is entitled for have been withheld only on the ground that he had gone on study leave on 22.01.1991 till 29.11.1991, which period has not been regularized so far. Counsel for the petitioner states that regularization of the said period is to be done by the respondents themselves and the respondents cannot delay the grant of benefits to the petitioner after his retirement only due to their inaction, which is totally attributable to the respondents themselves.
Counsel for the petitioner further states that for the relief which has been sought in the present writ petition, the petitioner has submitted a representation dated 14.01.2019 (Annexure P-9) to the NARESH KUMAR 2019.03.25 13:16 I attest to the accuracy and integrity of this document Chandigarh
CWP-6986-2019 -2respondents, which is still pending consideration with them and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said representation. In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the representation dated 14.01.2019 (Annexure P-9) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.
Present writ petition stands disposed of.
