(ORAL) Learned counsel for the petitioner submits that the petitioner is similarly placed as the other co-accused, who have already been admitted to bail by this Court, i.e. Amritpal Singh and Arjun Chauhan, inasmuch as, the aforesaid two co-accused and the petitioner are all stated to have been named by one Varun Kumar, who stated in his statement that he had earlier seen them in the evening in the vicinity of the truck being loaded with liquor.
Mr. Pannu, learned Deputy Advocate General, Punjab, submits that the petitioners' role is different to the extent that he is stated to have driven the truck away.
Having considered the above, it is seen that the co-accused of the present petitioner have been granted bail essentially for the reason that the petitioners have been arraigned as accused on the statement of a person who did not state that he actually saw them at the spot, but that they were Virendra Singh Adhikari 2017.06.06 14:55 I attest to the accuracy and authenticity of this document High Court Chandigarh the persons who were roaming around in the area when the truck was being

Hence, considering the fact that the petitioner has been in custody for 05 months, with the trial stated to be at the initial stage, this petition is allowed. The petitioner is ordered to be admitted on bail, upon his furnishing adequate bail and surety bonds to the satisfaction of the trial Court.
