RITU BAHRI , J (ORAL) Petition is for grant of regular bail in case FIR No.65 dated 23.10.2015 under Sections 363,366A,368,376,212,120-B IPC and Sections 3 & 4 of POSCO Act, 2012, P.S City-2 Abohar, District Fazilka. As per the allegations in the FIR, daughter of the complainant had eloped with Gurjant Singh and stayed at Amritsar for some time. Thereafter, they contacted the wife of present petitioner, who is brother in law of said Gurjant Singh and stayed in their house for few days. After registration of FIR, statement (Annexure P.2) of the girl- Rupinder Kaur was recorded under Section 164 Cr.P.C in which she stated that she had accompanied Gurjant Singh of her own sweet will. She further stated that her family had beaten her as well as Gurjant Singh and that Gurjant Singh had never harmed her as she wanted to live with him forever. She requested for sending her to Nari Niketan instead of her home. Learned counsel for the petitioner submits that the petitioner has no concern with the present case and has been falsely roped in. CRM-M- 20115 of 2016 #2# submitted that the petitioner is in custody since 12.11.2015. Learned state counsel, on instructions from ASI Baljeet Singh, has informed that out of 22 witnesses, none has been examined so far. Keeping in view the facts of the present case and taking into account the fact that the completion of trial shall take sufficient time, no useful purpose would be served by keeping the petitioner behind bars any further.

Bail to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Fazilka.
