Mr.R.S.Sachdev, Advocate, for the complainant. Rajan Gupta, J (Oral) Petitioner was granted interim bail vide order dated 23.2.2016 due to his long incarceration. This court noticed earlier that trial of the case was proceeding at a snail's pace. Today, learned State counsel has informed that out of 80 witnesses cited by the prosecution, only 4 have been examined. He, on instructions from HC-Satpal Singh, further submits that prosecution shall endeavour to conclude its evidence as early as possible. Petitioner is regularly attending the proceedings after grant of interim bail.

In view of above, order dated 23.2.2016 is made absolute subject to petitioner furnishing fresh bail bonds to the satisfaction of trial court. In case, trial is delayed due to absence of any of the accused before the court below, State shall be at liberty to move application for cancellation of bail under Section 439 (2) Cr.P.C. Allowed in these terms.
