******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 read with Section 482 of Code of Criminal Procedure for grant of interim bail to the petitioner in case FIR No. 134 dated 12.02.2016 registered at Police Station Civil Lines, Karnal, District Karnal.

Heard.

Learned State counsel submits that the prosecution has already concluded the evidence in this case and the case is now fixed for 15.07.2017 for DWs.

Learned counsel for the petitioner submits that surgery has been fixed for wife of the petitioner as per opinion of doctors of Nishan Hospital (Annexure P-2) and he has to arrange finances for her surgery (hysterectomy).

Earlier also the petitioner was allowed bail on medical ground in the year 2016 and he has surrendered on time. Keeping in view the request of learned counsel for the Jitender Kumar 2017.07.06 17:05 I attest to the accuracy and integrity of this document CHANDIGARH

CRM-M-19241 of 2017 -2petitioner, which is supported by medical evidence, the present petition is allowed. Petitioner-Sahab Singh is ordered to be released on interim bail w.e.f. 11.07.2017 to 25.07.2017 on his furnishing adequate surety bond to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate. During period of his bail, Karnal police will keep a watch on his movement. He will surrender before the jail authorities on 25.07.2017 by 05.00 p.m. It is, however, made clear that trial of the case will continue during this period and any attempt made by the petitioner to evade/delay the trial will result in cancellation of his bail.
