The petitioner is alleged to have sold his property beyond his share to Baba Zorawar Singh Baba Fateh Singh Mata Gujjar Kaur Gurudwara Sahib in connivance with the members of the Managing Committee of the above said Gurudwara Sahib.

Counsel for the petitioner has submitted that as per the revenue record existing since 1975-76, the petitioner had been shown as owner of 2 kanal 4 marlas of land, which has been sold. Learned State counsel has opposed the petition contending that the petitioner actually owned only 5 marlas of land. Civil litigation regarding the transfer is stated to be pending between the parties. Pursuant to the interim order, the petitioner has already joined the investigation, as per the instructions of ASI Surjan Singh, imparted to the learned State counsel. It does not appear to be a case of custodial interrogation.

The petition is allowed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that the petitioner will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
