RITU BAHRI , J (ORAL) Petition is for grant of regular bail in case FIR No.05 dated 08.1.2016 under Sections 366(A), 363,419,420,468,471,120-B,380,34 IPC, P.S Sadar Sirsa, District Sirsa.

As per the allegations made in the FIR registered on the statement made by the complainant-Sanjay Kumar on 08.01.2016, sisterRekha of the complainant after having dinner on 07.1.2016 was not found in her room. It is further alleged that said Rekha while misrepresenting her as Sonu Rani had approached this Court by filing petition bearing CRM-M829 of 2016 and used the DMC of said Sonu Rani to show her age to be 04.01.1998 and thereafter got protection from this Court whereas the actual date of birth of Rekha Rani as per record is stated to be 18.6.1999 and she is a minor.

Learned state counsel, on instructions from ASI Dharam Pal, does not dispute that protection was granted by this Court on 14.3.2016. She submits that the question of identification of the complainant's sister,

CRM-M- 20173 of 2016 #2# who had eloped with the petitioner, is subject matter of consideration and the same shall be decided after the trial is over. It is submitted that the challan has been presented on 04.5.2016.

Keeping in view the facts of the present case and taking into account the fact that the trial is not going to be completed in near future, no useful purpose would be served by keeping the petitioner behind bars any further.

Bail to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Sirsa.
