IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH

CRM-M-19275-2017 (O&M) Date of decision: 16.07.2018 Sukhjinder Singh and others ..... Petitioners

Versus

State of Punjab and others ..... Respondents

CORAM:

HON'BLE MR. JUSTICE RAMENDRA JAIN PRESENT: Mr. Brij Mohan, Advocate for Mr. DS Sobati, Advocate for the petitioners.

Mr. Davinder Bir Singh, DAG, Punjab.

RAMENDRA JAIN, J. (ORAL) Through this petition under Section 482 Cr.P.C., the petitioners have prayed for issuance of directions to respondents No. 1 to 3, to protect life, liberty and property of the petitioners and their family members at the hands of respondent No. 4, at the behest of private respondents 5 to 12. Further prayer has been made for transferring respondent No. 4-ASI Avtar Singh, SHO, Police Station Mattewal, being a biased police officer. On instructions from HC Avtar Singh, learned State counsel submits that this petition has rendered infructuous, in view of the fact that respondent No. 4-ASI Avtar Singh, SHO, Police Station Mattewal has already been transferred on 22.05.2017 to Police Lines and he never investigated FIR No. 21 dated 09.04.2017 (Annexure P-2), under Section s 379 and 411 IPC, Police Station Mattewal, District Amritsar (Rural). He further submits that final report under Section 173(2) has already been filed in Court against petitioners No. 8 and 9, namely, Rachhpal Singh and Narinder Singh.

In view of the above, the instant petition is dismissed as having rendered infructuous.
