The petitioner has filed this petition under Section 439(2) Cr.P.C. read with Section 482 Cr.P.C. seeking cancellation of anticipatory bail granted to respondent No.2/accused-Akash Verma vide order dated 10.8.2016 passed by this Court in case FIR No.464 dated 5.5.2016 registered for the offences under Sections 420, 406 and 120-B IPC at Police Station Sadar Gurgaon, Haryana.

I have heard learned counsel for the petitioner and have gone through the record.

At the time of arguments, learned counsel for the petitioner argued that the accused/respondent No.2 had concealed some important facts from the Court and the documents submitted by the accused/ respondent No.2 are forged one.

Cr. Misc. No.M-1931 of 2017 [2] accused/respondent No.2, counsel for the complainant/petitioner was also present. If it is taken as it is that respondent No.2-Akash Verma had concealed material facts from the Court, then as to why these had not been brought to the notice of this Court at that very time by the counsel for the complainant/petitioner or by the learned State counsel. Similarly, nothing has been pointed out at that time regarding any other document submitted to the Investigating Officer which is forged one. Even otherwise, the anticipatory bail had been granted to the respondent No.2 in view of the facts and circumstances of that case and in view of the prosecution case in the FIR. No ground is made out for cancellation of anticipatory bail granted by this Court to the accused/respondent No.2. Therefore, finding no merit in this petition, the same is dismissed.
