**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioners seek pre-arrest bail in FIR No. 32 dated 9.5.2015 under Sections 452/427/324/323/148/149 IPC registered at Police Station Lambra, District Jalandhar.

Notice of motion was issued and the interim protection was granted.

Learned counsel for the State, on instructions from ASI Amarjit Singh, submits that although in compliance of the order passed by this Court, both the petitioners have joined the investigation yet petitioner No. 1 did not get the recovery effected. Faced with the above, learned counsel for the petitioners submits that both the petitioners have joined the investigation and in view of the nature of allegations, none of the petitioners is required for the purpose of any further investigation. He prays for allowing the present petition.

Criminal Misc. No. M-19272 of 2015 Having heard the learned counsel for the parties and after careful perusal of record of the case, this Court is of the considered opinion that in the given facts and circumstances of the case, both the petitioners have been found entitled for the concession of anticipatory bail. It is so said, because petitioners have joined the investigation twice over. Further, there is no allegation of any misuse of interim anticipatory bail granted by this Court, by either of the petitioners.

In view of the above and without commenting anything further on the merits of the case, at this stage, lest it should prejudice the rights of either of the parties, instant petition is allowed and order dated 8.6.2015 passed by this Court is hereby made absolute, however, subject to the conditions provided under Section 438 (2) Cr.P.C.

Disposed of, accordingly.
