The petitioners have allegedly persuaded Suboth Kumar to transfer his land to Baba Zorawar Singh Baba Fateh Singh Mata Gujjar Kaur Gurudwara Sahib. Co-accused of the petitioners Suboth Kumar has been granted the concession of pre-arrest bail. Civil litigation, pertaining to the same land is pending, as is apparent from copy of the suit (Annexure P-4), filed by above said Gurudwara Sahib against Harminder Singh and others. On the instructions of ASI Surjan Singh, learned State counsel has informed that the petitioners have joined the investigation. Since the dispute regarding title is sub-judiced before the civil court, the petition is allowed and it is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer subject to the condition that they will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
