The prayer in the present petition under Section 483 BNSS is for the grant of regular bail in case bearing FIR No.158 dated 20.08.2025 (Annexure P-1) registered under Sections 25(1-B) (a)-54-59 Arms Act (Sections 111(2) (b)of BNS added later on) at Police Station Dujana, District Jhajjar, Haryana.

The present FIR came to be registered on the basis of secret information and reads as under:- "To the SHO Police Station, Dujana, Jai Hind. Today, I HC Sunil Kumar 714/JJR along with EHC Rohtash 1017: and Sepoy Ajay 1698 on private vehicle bearing number HR16T3195 with laptop printer were present for crime patrolling near village Dhaud Bus stand; that secret informer informed to me HC Sunil Kumar 714/JJR that Rahul Alias Bhairo, son of Jaiveer, resident of Dhaud is carrying illegal arms and is coming on Dhaud Dujana Road and if immediate raid is conducted then he can be apprehended. Secret
information from the informer is believable and informer sent back. I HC Sunil Kumar 714/JJR told about the information to the colleague employees and immediately started towards Dujana Road and after going to some distance, one person coming on foot was seen and I HC Sunil Kumar 714/JJR, apprehended the person along with fellow employees and asked him his name & address and then that person told his name as Rahul Alias Bhairo son of Jaiveer resident of Dhaud and at this time, one another person also seen coming: towards Dhaud and I HC Sunil Kumar 714/JJR asked his name address and said person told his name as Yashpal, son of Shri Raj Singh, resident of Dujana and then I HC Sunil Kumar 714/JJR disclosed about the present circumstances and included him in investigation as private witness.
I HC Sunil Kumar 714/JJR in presence of witness conducted the search of Rahul alias: Bhairo, then from the jeans he was wearing from the right side, one country made pistol was found which was checked by me HC Sunil Kumar 714/JJR and it was found to be loaded, then I HC Sunil Kumar 714/JJR unloaded the pistol and found one live cartridge and from the left side of Rahul Alias Bhairo one country made pistol was found in which there was no magazine and above person Rahul alias Bhairo in the left pocket of wearing jeans, one empty magazine was found and on asking by me HC Sunil Kumar 714/JJR Rahul alias Bhairo could not produce any license or permit and I HC Sunil Kumar 714/JJR prepared the Khaka and demarcated the pistol and live cartridge, then length of barrel was found as 15 cm and length of body found as 12 cm and the length of but found as 8.
5 cm and the Khaka was also prepared for second country made pistol and magazine and was Demarcated and it was found that the length of barrel is 11 cm. Length of body is 18.5 cm and length of but is 10 cm and length of magazine is 18.5 cm.
Country made pistol and magazine were put in plastic box and was stamped as SK and after using the stamp, the stamp was handed over to EHC Rohtash 1017 and both the pulandas of country made pistol, live cartridge and countrymade Pistol & magazine were taken into police possession through memo. On the memo, accused and witnesses signed. Accused Rahul Alias Bhairo, son of Jaiveer, resident of Dhaud by keeping the country made pistol along with live cartridge and country made Pistol with magazine has committed the offence under section 25(1B)(a)-54-59 A.Act. Therefore, the report is being sent through Sepoy Ajay 1698 to the police station, and after registering the case, case number be informed and for the next investigation is being sent to the other investigating officer.
I HC Sunil Kumar 714JJR, along with colleague employees and accused and case property is present on the spot. Today, Dhaud Dujana Road area, rakaba Village, Dujana HC Sunil Kumar 714JJR special staff Jhajjar dated 20.08.2025 at 6 PM today, Police Station, Hasa, Ahmed Tahrir, above sepoy Ajay, 1698 and receiving the case number: 158 dated 20.08.2025, under section: 25(1B)(a)-54-59 A.Act. is registered at police station, Dujana."

The learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. He is in custody since 20.08.2025 and the investigation stands concluded. Therefore, he be granted the concession of bail.

The learned counsel for the State, on the other hand, contends that pursuant to the arrest of the petitioner, the recovery of 02 country-made pistols, 01 live cartridge and 01 empty magazine came to be effected. The petitioner is a serial offender with multiple other cases registered against him. Therefore, he be not granted the concession of bail as prayed for.

In view of the nature of the allegations levelled against the petitioner as also his antecedents, I do not deem it appropriate to grant the concession of bail to the petitioner and therefore, the present petition stands dismissed.
