The prayer in the present petition under Section 528, 2023 is for the quashing of the order dated 06.06.2025 (Annexure P-12) passed by the Principal District and Sessions Judge, Tarn Taran, whereby the petitioner has been declared a proclaimed offender in FIR No.80 dated 02.06.2022 under Sections 302, 326 and 34 IPC, 1860 and Sections 25 and 27 of Arms Act registered at Police Station Sarhali, District Tarn Taran.

On 26.02.2036, the following order was passed:- "The prayer in the present petition under Section 528 of BNSS, 2023 is for quashing of the order dated 06.06.2025 (Annexure P-12) passed by the Principal District and Sessions Judge, Tarn Taran, in FIR No.80 dated 02.06.2022 under Sections 302, 326 and 34 of IPC, registered at Police Station Sarhali, District Tarn Taran, whereby the petitioner has been declared a proclaimed offender.

CRM-M-11242-2026 -2The learned counsel for the petitioner contends that due to the admission of the petitioner in a Deaddiction Centre, he was unable to appear on 06.06.2025 because of which the impugned order came to be passed. He states that the petitioner is ready and willing to join the proceedings once again.

Notice of motion for 23.04.2026.

Subject to a deposit of Rs.1,00,000/- as costs with the Spinal Rehab Centre, Chandigarh, Plot No.1, Madhya Marg, Sector 28-A, Chandigarh, the operation of the impugned order dated 06.06.2025 (Annexure P-12) shall remain stayed.

The petitioner shall surrender before the Court within 02 weeks and his bail application shall be decided on its merits."

In deference of the aforementioned order, the petitioner has sought the concession of anticipatory bail and has been granted interim anticipatory bail vide order dated 09.03.2026. A copy of the same is taken on record and marked as Mark 'A'.

In view of the fact that the petitioner has surrendered, submitted himself to the jurisdiction of the Court and has been granted interim anticipatory bail, the impugned order dated 06.06.2025 (Annexure P-12), whereby the petitioner has been declared a proclaimed offender stands quashed.

All the pending miscellaneous applications, if any, stand disposed of.
