SUDIP AHLUWALIA, J. (ORAL) Submits inter alia that the Complainant happens to be a Police Officer posted in the vicinity of the Police Station in which the present FIR has been lodged, in which allegations of intention to murder have been motivatedly made to harass the Petitioners after an unfortunate road-side accident involving the cars of both parties had taken place, even though the parties were not known to each other.

Submits further that under influence of the Complainant's official standing, the Local Police Authorities are determined to arrest the Petitioners even though they are permanent residents under the jurisdiction of the same Police Station and that the Anticipatory Bail Petitions of all the Petitioners are already listed before the Ld. Additional Sessions Judge, SBS Nagar on 31st of March, 2021, which is next working day in the said Court after today.

Mr. Sandeep Kumar, Dy. Advocate General, Punjab accepts notice on behalf of the Respondent-State. A copy of the paper book be handed over to him during the course of the day. 5.

Ex facie the Petition as filed would not appear to be strictly maintainable. However, considering the exceptional facts and circumstances narrated therein, as also the fact that the Complainant being a Police Officer herself would not appear to face any apprehension of intimidation to her life or security at the hands of the Petitioners, the matter at this stage is disposed off with a direction that till the next date of hearing already fixed before the Ld. Additional Session Judge, SBS Nagar, the Petitioners shall not be arrested in the present case.

The Ld. Court below is requested to pass an appropriate order as deemed fit in the given circumstances in case the pending Anticipatory Bail Petitions of the Petitioners are not finally disposed off on the next date fixed before it.
