CORAM: HON'BLE MR. JUSTICE ARUN MONGA

Present:

Mr. Sandeep Dhull, Advocate for the petitioner.

Mr. R.D.Sharma, DAG, Haryana.

**** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of Certiorari for setting aside orders dated 14.10.1998 (Annexure P-8), 15.06.1999 (Annexure P-10) and 17.01.2001 (Annexure P-12) whereby pensionary benefits were declined to the petitioner. 2.

Petition was admitted for hearing on 12.11.2002. 3.

When taken up for final adjudication, learned counsel is unable to assist the Court for lack of instructions. Learned counsel for the petitioner states that despite attempts, his office could not contact the petitioner. In the premise, no useful purpose would be served to issue fresh notice to the petitioner as the same too would be an exercise in futility.

4.

It seems that by sheer effluxion of time and pendency of the writ petition for more than 20 years before this Court, either it has been rendered infructuous or even otherwise the petitioner seems to have lost interest in pursuing the same.

CWP-6489-2002 (O&M) -25.

Be that as it may, writ petition is dismissed with liberty to the petitioner to file an appropriate application in case any cause of action still survives.
