Petitioner has filed this petition under Section 482 Cr.P.C. against State of Punjab and other respondents for directing respondents No.1 and 2 to take action against concerned Investigating Officer for not taking any action against the accused persons specifically named and not arresting them in case FIR No.10 dated 21.02.2017 under Sections 302, 324, 323, 148 and 149 IPC registered at Police Station Banur, District Patiala. Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. VINEET GULATI 2018.07.27 12:36 I attest to the accuracy and authenticity of this document Chandigarh Learned State counsel submitted that challan in this case has
CRM No.M-19432 of 2017 -2already been presented and charges have already been framed. He further contended that some of the witnesses have also been examined and on application under Section 319 Cr.P.C., additional accused have been summoned. These facts have not been contested by learned counsel for the petitioner.
In view of the above facts, I find that no direction is required to be given to the Investigating Officer nor any further action is required in this case.
