******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.164 dated 31.08.2016 registered for offences punishable under Sections 307, 148 read with Section 149 of Indian Penal Code (for short, "IPC") and 25 of the Arms Act, at Police Station Division no. 8 Jalandhar, District Jalandhar.

Heard.

As per case of prosecution, Lal Chand @ Lali was caused injuries by the petitioner and his co-accused. About 20 injuries were found on the person of Lal chand @ Lali.

FIR was registered on the statement of wife of Lal Chand @ Lali, wherein the petitioner was not named. However, while appearing as PW-1, Lal Chand @ Lali has attributed specific injuries to petitioner, who was armed with khanda.

Learned counsel for the petitioner submits that the petitioner Jitender Kumar 2017.06.02 17:44 I attest to the accuracy and integrity of this document CHANDIGARH

CRM-M-19455 of 2017 -2was not named in the FIR and in the statement of Lal Chand @ Lali only one injury has been attributed to him.

In the occurrence of this type, where injured has been caused numerous injuries, it is not possible for him to recollect and specify each injury on his person and state as to who has caused the same. Keeping in view gravity of offence and nature of injuries caused to Lal Chand @ Lali, I do not find it to be a fit case to extend the benefit of regular bail to the petitioner, at this stage. Dismissed.
