(Oral) Prayer in the present petition filed under Section 438 of Cr.P.C. is for grant of anticipatory bail to the petitioners in case FIR No.68 dated 15.06.2015 registered under Sections 459, 323, 326, 506, 148 and 149 IPC (Sections 459, 326 & 506 added and 452 & 324 deleted later on) at Police Station City Dhuri., District Sangrur.

Learned counsel for the petitioner has argued that no role any overt act has been attributed to the petitioner. Moreover, the matter has been compromised.

Learned Deputy Advocate General on instructions from ASI Malkiat Singh states that the matter has been compromised and main accused is in jail.

CRM-M-11143 of 2019 -2that there is no allegation of any overt act against the petitioner except that he inflicted fist blows.

Keeping in view the above facts and circumstances of the case and without going into the merits of the case, I do not deem it appropriate to deny the concession of anticipatory bail to the petitioner. Resultantly, the petition is allowed. In the event of arrest of the petitioner, he shall be released on bail by the Investigating Officer subject to the conditions envisaged under Section 438(2) Cr.P.C.
