CORAM:
HON'BLE MR. JUSTICE RAMENDRA JAIN PRESENT: Mr. VP Singh, Advocate for the petitioner. Mr. Davinder Bir Singh, DAG, Punjab.
Mr. Bhavesh Aggarwal, Advocate for Mr. Ashish Aggarwal, Advocate for respondent No. 3. RAMENDRA JAIN, J. (ORAL) For verifying the stand taken by learned State counsel on the previous date i.e. 15.11.2018, learned counsel for respondent No. 3 prays for time to file affidavit of respondent No. 3, which seems to be a deliberate or intentional attempt to prolong this case.
Hence, adjournment sought by learned counsel for respondent No. 3 for filing affidavit is rejected and considering the version of learned State counsel to be true, the instant petition is allowed. Consequently, FIR No. 15 dated 31.01.2014 (Annexure P-2), under Sections 420 and 120-B IPC, Police Station 'B' Division, Amritsar City, District Amritsar, registered only on the allegation that plot in the name of wife of the petitioner sold to the complainant was shown as 'gali' in the revenue record and all the subsequent proceedings arising therefrom, qua the petitioner is quashed.
