RITU BAHRI , J (ORAL) Petitioner is seeking regular bail in case FIR No.156 of 2016 dated 16.05.2015 under Sections 323,346,366-A IPC and Sections 9,10 of Child Marriage Act, P.S Civil Lines, Sonepat. As per allegations in the FIR, the prosecutrix was detained from 15.1.2015 to 10.4.2015 by Sanjay Aggarwal and Madhu Aggarwal and thereafter she is alleged to have met the present petitioner, who after converting his religion married her. This fact has also been stated by the prosecutrix-Fiza Ali in her statement recorded under Section 164 Cr.P.C. Learned state counsel points out that after presentation of the challan, charges have been framed and out of 15 witnesses, 13 have already been examined.
Regular bail has since been denied to the petitioner vide order dated 12.8.2015 (Annexure P.5) passed by learned Addl. Sessions Judge, Sonepat on the ground that the prosecutrix was a minor girl and the petitioner had solemnized marriage after converting his relation from Hindu
CRM-M- 20409 of 2016 #2# to Muslim despite the fact that he is already a married man. Prosecutrix appeared before the trial Court and made a statement that the petitioner had assured her that he would divorce his wife. Even though, the challan has been presented against the other co-accused Madhu Aggarwal and Sanjay Aggarwal and they have been released on bail. Taking into account the gravity of the offence and the fact that the trial is at the fag end and the main allegations are against the present petitioner, no ground is made out to grant the concession of bail. Dismissed.
