ALKA SARIN, J. (Oral) CM-5485-CII-2022 This is an application for vacation of stay granted by this Court vide order dated 04.04.2022.

Learned counsel for the parties are ad idem that instead of hearing the application for vacation of stay, the main case itself may be taken up.

On the oral request of learned counsel for the parties, main case is taken on Board today itself.

CR-1238-2022 Petitioner-Naresh Kumar in person is present in Court and is identified by his counsel. The statement of the petitioner has been recorded separately.

CR-1238-2022 (O&M) -2Today, a demand draft of Rs.10,800.00/- issued by Union Bank of India being Draft No.942791 towards rent upto October 2022 has been handed by the counsel for the petitioner to the counsel for the respondentlandlord. Learned counsel for the parties are ad idem that the petitioner be granted 09 months' time to vacate the premises subject to his paying the agreed rate of rent by the 10th of every month. In view of the above, the present petition is disposed off granting the petitioner 09 months' time to vacate the premises. Rent has been paid upto October 2022. The rent from November 2022 towards shall be paid by the petitioner by the 10th of every month. The petitioner shall hand over peaceful vacant possession of the premises to the respondent on or before 28.02.2023. Pending applications, if any, also stand disposed off. Disposed off.
