ANOOP CHITKARA , J. (Oral) State counsel has raised the preliminary objection that the petitioner was granted interim bail on the judgment passed by learned Special Judge, Amritsar file the receipt of FSL report and now the FSL report has found the weighing of drug fall under the commercial quantity, for this reason the bail was cancelled. Now the petitioner coming to this Court for seeking quashing of the said order is beyond the scope of Section 528 BNSS.

At this stage, petitioner's counsel submits that he wants to file a petition under Section 482 BNSS provided the order the previous rejection is not come in his way in any manner. There is no dispute that the petitioner has statutory right to file a bail application for anticipatory bail under Section 482 of BNSS. It is further clarified that the order of rejection shall filing of the present petition shall not come in the petitioner's way. 3.
Given above, petitioner's counsel wishes to withdraw the instant petition with liberty aforesaid.
