These are two appeals preferred by the claimants seeking enhancement of compensation payable on account of death of Mangal Singh and Saroj Rani who lost their lives in a motor vehicle accident dated 05.11.2019. Both of them were working as skilled labourers at brick-klin. FAO-2214-2021 relates to compensation on account of death of Mangal Singh, who died at the age of 47 years. The Tribunal awarded compensation as under :- 10,000 1,20,000 Future prospects 25% 30,000 1,50,000 Deduction 50% 75,000 75,000 9,75,000 Parental consortium @ 40,000/- each 40,000 15,000 15,000 Keeping in view ratio of law laid down by Supreme Court in the case of National Insurance Company Ltd. vs. Pranay Sethi and others, 2017(4) RCR (Civil)1009 and Magma General Insurance Company Ltd., Vs. Nanu Ram @ Chuhru Ram & ors., 2018(4) RCR (Civil) 333 the award is modified to the following extent :- 10,000 (min wage-skilled) 1,20,000 Future prospects 25% 30,000
1,50,000 Deduction 1/3rd 50,000 1,00,000 13,00,000 Parental consortium @ 48,000/- each 96,000 18,000 18,000 FAO-2281-2021 relates to compensation sought on account of death of Saroj Rani who died at the age of 32 years. The Tribunal awarded compensation as under :- 8,000 96,000 Future prospects 40% 38,400 1,34,400 Deduction 50% 67,200 67,200 10,08,000 Parental consortium @ 40,000/- each 40,000 15,000 15,000 Keeping in view ratio of law laid down by Supreme Court in the case of National Insurance Company Ltd. vs. Pranay Sethi and others, 2017(4) RCR (Civil)1009 and Magma General Insurance Company Ltd., Vs. Nanu Ram @ Chuhru Ram & ors., 2018(4) RCR (Civil) 333 the award is modified to the following extent :-

Needless to say, the appellants shall be entitled to interest @7% per annum on the enhanced amount from date of filing of the claim petition till the date of actual realization. Any amount already paid to the claimants shall be set off.
