Mr.Aashish Grewal, Advocate, for the petitioner Mr. Munish Sharma, AAG, Haryana for the State Mr. BR Rana, Advocate, for the complainant Fateh Deep Singh, J. (Oral) Learned State Counsel, on instructions from ASI Yashpal, PS Women Palwal submits that the petitioner has since joined the investigation and is no longer required for further investigation and nothing is to be recovered from him and that he has no objection if the interim order is made absolute. Further-more it is contended by the learned State counsel that the prosecutrix failed to identify the petitioner in the test identification parade.
In the light of this stand of the State and the fact that a debatable issue over the identification of the accused has arisen and the prosecutrix happens to be a grown up girl aged around 22 years and claims to be known to the accused-petitioner are matters of much significance and thus, the interim bail granted to the petitioner vide order dated 15.5.2018 is made absolute till submission of report under Section 173 Cr.P.C. (challan). Thereafter, petitioner will be permitted to furnish regular bail bonds to the DALBIR SINGH TIWANA 2018.11.26 14:05 I attest to the accuracy and authenticity of this document Punjab and Haryana High Court, Chandigarh.
Criminal Misc. No. M-20531 of 2018 (O&M) -2satisfaction of the trial Court. The petitioner shall abide by the conditions laid down in Section 438(2) Cr.P.C.
