RAJESH BHARDWAJ, J.(ORAL) Prayer in the present petition is for issuance of a writ in the nature of certiorari for quashing/setting aside the ex-parte impugned order, dated 06.10.2015, Annexure P-5, passed by learned DDPO-cum-Collector/respondent No.2 vide which application under/Section 4 and 5 of Punjab Public Premises and Land (Eviction and Rent Recovery) Act, 1973 (for brevity,`the Act') Annexure P-4, has been allowed and ejectment order has been passed against the petitioner and he was directed to hand over the possession to respondent No.3. It is further prayed to quash/set aside the impugned order dated 11.04.2019, Annexure P7, passed by learned Joint Commissioner Development (IRD), Punjab vide which appeal under Section 9 of the Act, Annexure P-6, filed by the petitioner has been dismissed.

It is also prayed to dismiss the ejectment application filed by respondent No.3 against the petitioner. It is further prayed to stay the operation of impugned orders, dated 06.10.2015 and 11.04.2019, Annexures P-5 and P-7 during pendency of the present petition. MEENU 2024.03.

CWP-6837-2020 -2It has been submitted by learned counsel for the petitioner that petitioner has already died on 24.08.2023 and his legal heirs are not coming forward, hence he is not able to pursue the present petition and thus the same may be dismissed as such.

In view of the submission made above, the present petition is dismissed for want of prosecution with liberty to legal heirs of the present petitioner to get it revived if they want to do so. March 04, 2024 ( RAJESH BHARDWAJ ) meenuss JUDGE 1.
