(ORAL) By way of this peon filed under Arcle 226/227 of the Constuon of India, peoner prays for issuance of a writ in the nature of cerorari for quashing the charge-sheets dated 11.10.2023 (Annexure P-2) issued by respondent No.4 and dated 26.02.2024 (Annexure P-6), alleging the same to be illegal, arbitrary and result of mala fide. At the outset, learned counsel for respondent Nos. 2 to 6 informs that on the basis of impugned charge-sheets, the enquiry was conducted and the enquiry report dated 07.06.2024 has already been submi7ed by the Enquiry Officer and based thereon, show cause noce has also been served upon the peoner. Peoner has even filed reply to that show cause noce.

Learned counsel for the peoner has drawn a7enon towards the order dated 25.07.2024 passed by this Court, whereby further acon PRIYANKA 2025.02.11 17:18 I attest to the accuracy and integrity of this document

CM-17516-CWP-2024 in/and -2CWP-5894-2024 based upon the show cause noce dated 13.06.2024 (Annexure P-9) was directed to be stayed.

Learned counsel for the peoner wants to assail the enquiry report along with the show cause noce. Learned counsel seeks permission to withdraw the present peon with the aforesaid liberty. Learned counsel for the respondents have no objecon.

In view of the aforesaid statement, the present peon is hereby disposed of as withdrawn with liberty to the peoner to assail the enquiry report dated 07.06.2024 along with the consequent show cause noce, provided peon in this regard is filed within next 02 weeks. Till the filing of the peon within 2 weeks, any further acon based upon show cause noce dated 13.06.2024 shall remain stayed. Disposed of.
