Mr. Bhag Singh, Advocate, for respondent No.2. PARAMJEET SINGH, J. (ORAL) Instant petition under Section 439(2) read with Section 482 of the Code of Criminal Procedure has been filed for cancellation of anticipatory bail granted to respondent No.2 in case arising from FIR No.239 dated 17.09.2011 registered under Sections 406/420/467/468/471/506 IPC at Police Station Mulana, District Ambala.

Heard.

On 07.04.2015 respondent No.2 filed his affidavit that in case petitioner pays the balance sale consideration of the share of respondent No.2, he is ready to execute the sale deed of his share as per the agreement to sell dated 06.11.2006.

In view of the affidavit of respondent No.2, petitioner was RAVINDER SINGH 2015.04.23 10:43 I attest to the accuracy and authenticity of this document

-2Crl. Misc. No. M-23657 of 2012 directed to file affidavit to the effect that in case respondent No.2 complies with the terms of the agreement to sell, petitioner will not press the present petition and will make a statement for quashing of FIR on the basis of compromise.

In compliance of the order dated 07.04.2015, Ranjit Singh, son of the petitioner has filed his affidavit dated 21.04.2015, which is taken on record, to the effect that if respondent No.2 gets the sale deed registered in favour of the petitioner or in favour of Ranjit Singh, he, being power of attorney of the petitioner, will make a statement for quashing of FIR in question on the basis of compromise and wants to withdraw the present petition.

In view of the affidavits of Ranjit Singh son of the petitioner as well as respondent No.2, present petition is dismissed as withdrawn. (Paramjeet Singh) Judge April 21, 2015 R.S.
