Through the present petition filed under Section 439 Cr.P.C., the petitioner seeks the grant of regular bail in FIR No. 72 dated 14.04.2015, under Sections 406, 420, 342, 506, 120-B IPC, registered at Police Station Machhiwara, District Khanna.

Seeking regular bail for the petitioner, learned counsel submits that the petitioner has been in custody for over 08 months; there is no other criminal case pending against him; report under Section 173 Cr.P.C. has been filed by the prosecution and since the trial is yet to commence, it is not likely that it will conclude in the near future. Learned State counsel does not dispute the aforesaid factual position.

Crl. Misc. No. M-197 of 2017 Considering the aforesaid submissions, in my opinion, no useful purpose would be served by putting the petitioner in incarceration any more.

Resultantly, the present petition is allowed and the petitioner is ordered to be released on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Ludhiana.

Nothing observed herein above shall be considered to be an expression of opinion by this court on the merits of the case. If the petitioner is found indulging in any other criminal act or misusing the concession of bail granted by this Court, it would be open to the State to seek cancellation of bail granted through this order by filing an appropriate application before the competent Court/this Court.
