Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.42 dated 31.07.2016 under Sections 363/366A/120B IPC (the offences punishable under Sections 376/467/468 IPC and Sections 3/4 of the Protection of Children from Sexual Offences Act, 2012 were added later), registered at Police Station Rangar Nangal, Police District Batala, District Gurdaspur.

While issuing notice of motion on 02.06.2017, this Court passed the following order:- "It is submitted that the petitioner has been summoned on an application under Section 319 Cr.P.C. His name does not figure in Omkar Singh 2017.07.26 10:32 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-19721 of 2017 [2] the FIR. The petitioner is falsely implicated in this case due to his relationship with the accused Jagroop Singh, who is the petitioner's son. Jagroop Singh and the complainant's daughter solemnized marriage against the wishes of the complainant. Notice of motion for 25.07.2017.

In the meanwhile, the petitioner is directed to appear before the learned trial court on or before 07.06.2017. On appearance, he be admitted to interim bail in the meanwhile, subject to satisfaction of the learned trial court."

Learned counsel for the petitioner submits that pursuant to orders dated 02.06.2017 and 21.06.2017 passed by this Court, the petitioner has appeared before the learned trial court on 03.07.2017. Learned counsel for the State, on instructions from ASI Charanjit Singh, verifies that the petitioner is not involved in any other case. There are no allegations on behalf of the State that the petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail.

Keeping in view the facts and circumstances as above but without commenting upon or expressing any opinion on the merits of the case, this petition is allowed. Interim bail afforded to the petitioner by the learned trial court be made absolute subject to the petitioner submitting fresh bail bonds and surety to the satisfaction of the learned trial court.
