**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 181 dated 11.4.2017 registered at Police Station Gannaur, District Sonipat under Sections 323, 363, 366-A, 376 IPC and Section 6 of Protection of Children from Sexual Offences Act, 2012.

A complaint was made that two daughters of the complainant had been kidnapped by 5 persons. One of the girl was a minor. The minor returned home and told her family that she had been raped. She also made a complaint that her sister had been raped by 2-3 men. The elder girl, on recovery, made a statement that she had left home on her own and had married Sanjay, one of the accused and that she did not want to live with her parents. The younger one was got medically examined. There was no reference to any injury or that she had been physically violated. Counsel for the petitioner submits that he seeks parity with Ravi who was allowed bail on 16.4.2018. Crl. Misc. No. M-20654 of 2018 -2the petitioner is similar to that of Ravi.

The name of the petitioner was disclosed by Sanjay. There are no accusation of rape on him.

State counsel had also informed that the complainant and the prosecutrix are not appearing for the statements and now non-bailable warrants of arrest have been issued for 18.7.2018. In view of the above position, bail is allowed and the petitioner is ordered to be released on bail on his furnishing surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate.
