Petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.54 dated 19.09.2014 under Sections 365 IPC (Sections 302, 364, 201, 404 and 120-B IPC added later on), registered at Police Station Sadar Pathankot, District Pathankot. Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that earlier, the petitioner has also filed the petition for bail, which has been dismissed by this Court. Now, it has been brought to the notice of this Court that file has been received by the Vineet Gulati 2018.07.03 16:37 I attest to the accuracy and authenticity of this document Chandigarh trial Court but the witnesses have not been examined so far and case is at

CRM No.M-20669 of 2018 -2preliminary stage. There is no changed circumstance after the dismissal of first petition. Further, the petitioner was earlier declared Proclaimed Offender and then he was arrested. As the case is at preliminary stage, no ground is made out for grant of regular bail to the petitioner. Therefore, finding no merit in the present petition, the same is dismissed.

However, learned trial Court is directed to expedite the trial and Senior Superintendent of Police, Pathankot is directed to take effective steps for producing the accused before the trial Court from the jail, where he has been lodged.
